Shortly after Sirius Black escaped from Azkaban, Minister Fudge drafted a law that passed both the Ministry and the Wizengamot. A reward of a thousand galleons for capturing and turning in any escaped Azkaban prisoner, dead or alive. The reason for the incarceration is irrelevant. It was basically a “kill on sight” for Sirius. When Sirius was declared dead after the battle in the Ministry, the law was forgotten.
After the Final Battle at Hogwarts, Kingsley Shacklebolt was voted in as Acting-Minister. He gathered as much information he could about the war to create an accurate history. Two things were discovered.
One, that a large number of Death Eaters that escaped Azkaban with help from Lord Voldemort, other Death Eaters, and the lack of Dementors, were seen fighting in the Final Battle but were never accounted for, captured or killed. There were no bodies.
And second, Harry Potter learns about the missing escapees and the forgotten law.
